Wetlands

  • Agency Negotiations: The complexity of today’s permitting processes often necessitates interaction among multiple parties. Capital specializes in strategy and settlement negotiations associated with environmental permitting violations or the difficult-to-obtain wetland permits. We are highly experienced in negotiation with Federal and State agencies. Capital works extensively with the New York State Department of Environmental Conservation (NYSDEC), U.S. Army Corps of Engineers (ACOE), and New York City Department of City Planning (NYCDCP) on a variety of projects.
  • Delineation: The accurate delineation of Federal and State wetlands is a critical element to evaluating regulatory issues and potential impacts associated with real estate development or the expansion of existing facilities. While the use of standardized methodologies is required, substantial field experience and training are necessary for implementation, particularly in areas where ambiguous indicators exist and critical land use is at stake. We perform wetland delineations following the ACOE and State methodologies. Capital’s delineations facilitate the wetland permitting process on diverse and complex projects.
  • Mitigation: The development or assessment of mitigation plans designed to compensate for disturbance of State and Federally protected wetlands is often required. We regularly develop, critique, provide comments, and assist in the implementation of comprehensive mitigation plans. Capital's staff has designed successful artificial wetlands throughout the five boroughs of New York City and the Hudson Valley.
  • Environmental Impact Assessments: Environmental impact assessments are required by many local and state regulations, including SEQRA and CEQR, prior to issuance of a wide variety of permits related to property development. We develop environmental impact assessments/statements that can include wetland and ecological assessments, wildlife inventories, threatened and endangered species searches, and mitigation plans to reduce project impacts. We also review and critique assessments prepared by others to determine technical and regulatory accuracy as well as prepare comments and testify in support of our evaluations.

Stormwater

The regulatory focus on the pollutants associated with stormwater management is greatly expanding as the impacts of polluted stormwater runoff are becoming better understood. Current stormwater regulations require the development of detailed stormwater management plans also known as Stormwater Pollution Prevention Plans (SWPPPs) that detail stormwater control during and after construction. Capital has extensive experience in both construction and industrial stormwater management and treatment. Capital works with engineers and architects to design stormwater controls, develop pre- and post-development hydrologic balances, ensure wetlands sustainability, and design erosion control measures.

Permitting

Capital has extensive experience with assembling, submitting and obtaining federal, state, and local environmental permits for both large and small-scale projects.

  • Wetlands Permits: Capital has successfully obtained freshwater and tidal wetland permits within the five boroughs of New York City and the Hudson Valley for both straightforward and complex sites. We provide full wetlands permit support services including wetland delineations following ACOE and state methodologies, development of wetland mitigation plans, permit review, and permit violation negotiation and resolution.
  • Stormwater Permits: Capital partners with architects, engineers, and project planners to address stormwater and site hydrology issues both pre- and post-development. Capital has extensive experience with stormwater management including calculating stormwater balances, stormwater management practice selection, and water quantity and quality calculations.

Natural Resources

Capital’s highly trained staff are well versed in the methodologies required to perform four-season Natural Resource Inventory assessments in conjunction with SEQR and CEQR requirements.

The review of data, cataloging and analyzing of flora and fauna associated with site development, is a critical component of environmental impact assessments. Capital has experience collaborating with other consultants as part of a project team to deliver natural resource assessments for Environmental Impact Statements (EIS).

Project Management

Capital provides unique project management skills that serve to bring together and coordinate diverse project teams towards a single, unified goal of a successful project. Coupling technical expertise and experience in projects dealing with a wide range of environmental issues allows Capital staff to understand and focus on critical paths in order to streamline project timelines and efficiently complete projects in a timely manner. Greg Fleischer, PWS

Founder and Principal

Greg, founder and principal of Capital Environmental Consultants, Inc., is an environmental scientist and wetlands specialist with more than 17 years of experience in the environmental consulting industry, developing solutions and providing strategic advice for a wide range of clients and projects. Greg holds a BS in Biology from SUNY New Paltz and an MS from Pace University in Environmental Science. He is very active in the local community. When not in the field or at the office, Greg is an avid outdoorsman who can be found exploring the nearby Hudson River and Catskill Park with his family (wife and daughter). Otherwise, he can be found fishing along the banks of the many streams and lakes throughout the Hudson Valley.

Kelly DeGuzman

Environmental Scientist

Kelly is an environmental scientist at Capital Environmental Consultants, Inc., and has been involved in the environmental consulting field for 10 years. She brings technical expertise to each unique circumstance encountered during wetland and stormwater permitting processes. Kelly holds a dual AS in Liberal Arts and Engineering Science from SUNY Orange and a BS in Geology from SUNY New Paltz. Her attention to detail and enthusiasm for precision makes her a valuable component to every project team. In her community Kelly is an active volunteer involved with organizing and running local events such as street fairs and music in the park, in addition to heading her local scholarship committee.
